Our insurance team has been instructed in the drafting and review of dozens of insurance policies including whole suites of professional indemnity wordings on behalf of both Lloyd’s and company market insurers. Our approach to this is based on an appreciation of claims trends that are developing in relation to particular professions as well as an understanding of changes and developments in the law ushered in through new untested legislation as well as judicial authority. We have been tasked with developing wordings for particular facilities and at the heart of a successful marketable wording is the avoidance of surprises: from the insurers’ perspective this means not inadvertently creating providing cover for exposures outside of that was intended at the acceptance of the risk; equally from the brokers’ and insureds’ perspective it involves transparency as to what is and what is not covered.
