On 15 January 2021, the Supreme Court handed down its decision in the FCA Business Interruption Test Case. Sam Moore has prepared a note on the case. The insurers’ appeals were dismissed although the Supreme Court reached that decision via by fundamentally different analysis to the High Court in a number of important respects.
