Our team have a depth of experience in defending claims made against Directors & Officers and entities notified under D&O insurance policies.

As well as defending such claims, we have experience of acting as monitoring Counsel on behalf of insurers, examining policy coverage, reporting on the progress of the defence of the claim and advising on suitable reserves.

Our team have a depth of experience in advising on D&O policy wordings, policy coverage issues, as well as claims handling for D&O accounts, and acting as monitoring Counsel for Insurers on D&O matters. They have advised on both UK and international policies. The types of claims covered have been wide-ranging including not only employment related claims and claims arising out of a variety of financial transactions, but also potential exposure to liabilities in respect of industrial and construction accidents, environmental and financial services offences, as well as claims against educational institutions, charities, clubs and societies. In the role of monitoring Counsel, the team take a positive and proactive approach to developing and agreeing an effective strategy for defended claims in conjunction with the Insured’s own legal team, helping to achieve greater predictability of costs for Insurers.

The team have also defended contested claims on behalf of Insurers where coverage issues have arisen.

In addition to the above, members of the team have experience in assisting and advising Directors, Officers and Limited Liability Partners on their potential liabilities, as well as defending direct claims made against Directors, Officers and Limited Liability Partners. Philip Atkinson has a particular interest in advising directors and officers on corporate responsibility issues, best practice, and environmental related matters and exposures. We also offer advice to non-executive directors on their role and issues arising from it.

Philip has handled numerous claims for insurers on D&O accounts and represented insurers on a wide variety of D&O claims involving companies, societies, clubs, and other organisations. He has handled a number of coverage disputes for Insurers, including disputes regarding underlying US discrimination and employment related claims, and in connection with underlying vicarious liability claims (both in the UK and US). He has advised on coverage aspects and exposures of directors and officers to regulatory offences in connection with trading and other financial transactions conducted in the UK and New York, breaches of conduct rules and disciplinary matters. In the UK, he has handled claims arising from potential liabilities under competition law, and potential regulatory offences in connection with pollution and Health & Safety incidents. He has experience of acting both for and against directors and officers in the context of several judicial review claims.

Janet specialises in professional negligence and insurance litigation. She has acted on behalf of a wide range of professionals, including those involved in the construction industry (architects, engineers, surveyors) and the financial services sector, and solicitors. She has also been involved in coverage and D&O disputes.

She has extensive experience of litigation in the English courts, as well as international arbitration. She aims to resolve claims effectively, whether through court proceedings, Pre-Action Protocols or Alternative Dispute Resolution, such as mediation. Janet has been involved in a number of high profile cases.

Prior to joining Caytons Law, she worked for a number of years with a leading specialist professional indemnity practice.
