Sometimes it is either not
possible or not appropriate to settle a
dispute. It may be that the claim being pursued is not valid or the claimant may be
unreasonable in its demands. Matters of principle or precedent
must also be
fought. An assessment must be
made as early as possible to determine whether a
claim is to be settled. If a claim is to be
fought we set reserves appropriately and prepare
the case in order to produce the greatest
probability of a successful
outcome at trial. Unlike some, we will not
change course unless something fundamental
arises.
